_{Welcome to Bnshops! These Terms and Conditions ("Terms") govern your use of the Bnshops website, mobile application, and any related services (collectively, the "Platform") operated by Bnshops ("we," "us," or "our"). By accessing or using the Platform, you ("you," "User," or "Customer") agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.}

_{1.1 **Eligibility**: The Platform is available only to individuals who are at least 18 years old and capable of entering into legally binding contracts under applicable law. By using the Platform, you represent and warrant that you meet these requirements.}  

_{1.2 **Acceptance of Terms**: Your use of the Platform constitutes your acceptance of these Terms, as well as our Privacy Policy, which outlines how we handle your personal information.}  

_{1.3 **Modification of Terms**: We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on the Platform, and your continued use after such changes signifies your acceptance of the updated Terms. We encourage you to review these Terms periodically.}

_{#### 2. Use of the Platform}  

_{2.1 **Personal Use**: The Platform is intended for personal, non-commercial use only unless otherwise agreed in writing. You may not use the Platform for resale, distribution, or any other commercial purposes without our express consent.}  

_{2.2 **Account Creation**: To access certain features, you may need to create an account. You are responsible for providing accurate, current, and complete information and for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.}  

_{2.3 **Prohibited Activities**: You may not:}  

_{- Use the Platform for any unlawful purpose or in violation of these Terms.}  

_{- Attempt to interfere with the Platform’s functionality, security, or integrity (e.g., hacking, introducing viruses).}  

_{- Misrepresent your identity or provide false information.}  

_{- Use automated systems (e.g., bots) to access the Platform without permission.}  

_{#### 3. Products and Services}  

_{3.1 **Product Availability**: All products and services listed on the Platform are subject to availability. We reserve the right to discontinue or modify any product at any time without prior notice.}  

_{3.2 **Pricing**: Prices are displayed in Tanzanian Shillings (TZS) unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders already confirmed. We strive to ensure pricing accuracy; however, if an error occurs, we reserve the right to cancel or adjust the order and notify you accordingly.}  

_{3.3 **Taxes and Duties**: Prices may exclude applicable taxes, duties, or shipping fees, which will be calculated and displayed at checkout unless otherwise stated. For international orders, you are responsible for any additional customs fees or import duties.}  

_{3.4 **Product Descriptions**: We aim to provide accurate descriptions and images of products. However, we do not guarantee that all details (e.g., colors, sizes) will be exact due to variations in displays or manufacturing.}

_{#### 4. Orders and Payment}  

_{4.1 **Order Placement**: Placing an order constitutes an offer to purchase. We will confirm acceptance via email or notification, at which point a binding contract is formed. We reserve the right to refuse or cancel any order for reasons including stock unavailability, pricing errors, or suspected fraud.}  

_{4.2 **Payment Methods**: We accept various payment methods, including mobile money (e.g., M-Pesa, Tigo Pesa), cash on delivery (COD), and bank cards where available. Payment must be completed before shipment unless COD is selected.}  

_{4.3 **Mobile Money Payments**: For mobile money transactions, you must provide accurate payment details. We are not responsible for delays or errors caused by incorrect information or third-party payment providers.}  

_{4.4 **Cash on Delivery**: COD is available in select locations within Tanzania. You agree to pay the full amount in cash upon delivery. If you fail to complete payment, we may charge a restocking fee or pursue recovery costs.}  

_{4.5 **Payment Security**: We use secure payment gateways to protect your information. However, we are not liable for losses resulting from unauthorized access to your payment details outside our control.}

_{#### 5. Shipping and Delivery}  

_{5.1 **Shipping Locations**: We ship within Tanzania and to select international destinations as indicated on the Platform. Delivery times and costs will be provided at checkout.}  

_{5.2 **Delivery Process**: We aim to dispatch orders promptly, but delivery times are estimates and may vary due to factors beyond our control (e.g., weather, logistics delays). You are responsible for providing a correct delivery address.}  

_{5.3 **Risk of Loss**: Ownership and risk of loss transfer to you upon delivery to the shipping carrier for prepaid orders or upon receipt for COD orders.}  

_{5.4 **Failed Delivery**: If delivery fails due to an incorrect address or your unavailability, we may charge additional fees for redelivery or cancel the order and issue a refund (minus shipping costs).}

_{#### 6. Returns, Refunds, and Cancellations}  

_{6.1 **Cancellation by You**: You may cancel an order before it is shipped by contacting us. Once shipped, cancellations are subject to our return policy.}  

_{6.2 **Return Policy**: We accept returns within 14 days of delivery if the product is unused, in its original packaging, and in the same condition as received. Return shipping costs are your responsibility unless the product is defective or incorrect.}  

_{6.3 **Defective or Incorrect Items**: If an item is damaged, defective, or not as described, notify us within 7 days of receipt with evidence (e.g., photos). We will provide a replacement or refund, including return shipping costs, at our discretion.}  

_{6.4 **Refunds**: Refunds will be processed within 14 days of receiving the returned item, using the original payment method where possible. For COD orders, refunds may be issued via mobile money or bank transfer.}  

_{6.5 **Non-Returnable Items**: Custom-made products, perishable goods, or items marked as non-returnable are not eligible for return unless defective.}

_{#### 7. Intellectual Property}  

_{7.1 **Ownership**: All content on the Platform (e.g., text, images, logos) is owned by Bnshops or its licensors and protected by copyright, trademark, and other laws.}  

_{7.2 **Limited License**: You are granted a limited, non-exclusive license to access and use the Platform for personal shopping purposes. You may not reproduce, distribute, or modify any content without our written permission.}

_{#### 8. Limitation of Liability}  

_{8.1 **Disclaimer**: The Platform and products are provided "as is" without warranties beyond those required by law. We do not guarantee uninterrupted access to the Platform or that it will be error-free.}  

_{8.2 **Liability Cap**: To the fullest extent permitted by law, our liability for any claim arising from these Terms or your use of the Platform is limited to the amount you paid for the relevant product or service.}  

_{8.3 **Indirect Damages**: We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from your use of the Platform.}

_{#### 9. Privacy and Data Protection}  

_{9.1 **Data Collection**: We collect and process your personal information in accordance with our Privacy Policy. By using the Platform, you consent to such processing.}  

_{9.2 **Security**: We take reasonable measures to protect your data but cannot guarantee absolute security against breaches beyond our control.}

_{#### 10. Governing Law and Dispute Resolution}  

_{10.1 **Applicable Law**: These Terms are governed by the laws of the United Republic of Tanzania.}  

_{10.2 **Disputes**: Any disputes arising from these Terms will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to the exclusive jurisdiction of the courts in Dar es Salaam, Tanzania.}  

_{10.3 **Online Dispute Resolution (ODR)**: For customers outside Tanzania, disputes may also be submitted to an applicable ODR platform where required by law (e.g., EU regulations).}

_{#### 11. Termination}  

_{11.1 **By Us**: We may suspend or terminate your access to the Platform at our discretion if you violate these Terms or engage in activities that harm the Platform or other users.}  

_{11.2 **By You**: You may stop using the Platform at any time. Account deletion requests can be submitted via our contact channels.}

_{#### 12. Miscellaneous}  

_{12.1 **Force Majeure**: We are not liable for delays or failures to perform due to events beyond our control (e.g., natural disasters, strikes, government actions).}  

_{12.2 **Severability**: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.}  

_{12.3 **Entire Agreement**: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bnshops regarding your use of the Platform.}
